Employment Practices Liability
EPLI
Where can I find information on sexual harassment, wrongful termination,
discrimination, inappropriate employee conduct, demotion, defamation,
evaluation, retaliation, invasion of privacy and a host of other topics?
The answer? It's in your Employment Practices Liability insurance policy,
also known as EPLI.
The Policy
This policy covers a broad range of scary subjects. The term "inappropriate
employee conduct" can cover such items as sexual harassment, demotion,
defamation, wrongful termination, discrimination, retaliation, and invasion
of privacy. If it falls in the realm of employee relations, it is probably
covered under this policy.
Coverage
Coverage includes the duty to defend, defense for alleged violation of law,
coverage for bodily injury and personal injury arising from employment
practices liability (EPLI), claims for lost insurance benefits,
no exclusions for one insured bringing a claim against another insured and
epli insurance can sometimes be combined with directors and officers liability coverage for
a complete package of security and protection.
Loss Control
Employers occasionally need someone to talk to. Most carriers provide
a small amount of consultation time with an EPLI attorney and loss control
personnel. Risk management manuals and materials are provided to customers.
Employment contract provisions are reviewed as part of the annual policy review.
Third Party Coverage
Who has access to your employees and can cause you harm? Just about everyone
they deal with. Broad form employment practices liability guards against the
threat from outside sources such as the public, clients, customers, contractors,
governmental agencies, shareholders, directors, officers, patients, and vendors.
Eligibility
Most firms are eligible. Privately held companies are our normal customers.
We have even placed coverage for an Internet adult entertainment broadcasting
firm. If you are perceived to have deep pockets, then you are at risk for EPLI.
